Dear participants! In order to ensure maximum publicity and transparency in the procurement process, we are publishing questions and answers from potential bidders:
Question: Language of submitted documents. Can we submit documents on English, or it is obligatory to provide document on Ukrainian language? Does all documents need to be officially translated and authorized?
Answer: – The language of the tender proposal is Ukrainian. All documents prepared by the participant shall be presented in Ukrainian. If the tender proposal contains a document and/or information in a language other than Ukrainian, the participant shall provide their translation into Ukrainian. The participant shall be 2 responsible for the quality and accuracy of the translation. No other requirements for the translation are specified in the tender documentation.

Instruction for preparing tender proposal, Point 1. – Electronic submission and signature – OES/AES signature. Hittner Ltd. company is non-resident Participant. Can we just upload documents, or authorized person must use electronical signature? It is written that Non-resident may not sign electronically…
Answer: Non-resident Participants have the right not to sign their QES/AES proposal if it is not possible to do so in accordance with the procedure established by the current legislation of Ukraine. To submit the tender proposal, it is sufficient to upload scanned copies of the signed documents required under Anex 2 to the tender documentation.

Point 2.1. Absence of Grounds – There are some articles 42,45,47,50 Peculiarities… we do not understand what is this related to? Please note that Hittner Ltd. nor its official representative do not have any criminal record.
Answer: These are the provisions of the Ukrainian legislation regulating the conduct of public procurement in Ukraine, in particular «Peculiarities of Conducting Public Procurement of Goods, Works, and Services for Customers Provided for by the Law of Ukraine “On Public Procurement” for the Period of the Legal Regime of Martial Law in Ukraine and for 90 Days from the Date of Its Termination or Cancellation», approved by Resolution of the Cabinet of Ministers of Ukraine No. 1178 dated October 12, 2022, with amendments. https://zakon.rada.gov.ua/laws/show/1178-2022-%D0%BF?lang=en#Text. These provisions are also reflected in the instructions of the tender documentation, in particular
– article 42 – in the item 3 “Procedure for confirming information” of the section V. Tender proposal evaluation;
– article 45 – the item 7 “Tender proposal rejection” of the section V. Tender proposal evaluation;
– article 47 – in the item 6 “Grounds for refusal to participate in the procurement procedure” of the section III. Instructions for preparing tender proposals;
– article 50 – the item 1 “Cancellation of the tender” of the section VI. Results of bidding and conclusion of a procurement agreement
Question: Point 4 – Percentage of localization – Hittner Ltd. company has 100% assembly in Croatia with parts from European suppliers.
Answer: In this case, it necessary to fill a certificate (statement) by the required form confirming degree of localization or exemption from localization according to point 4.3 of Anex 2 – column 2 and 5 of this certificate. To confirm the non-application of the requirements for localization of manufacture, the participant fills out Column 5 of the form accordingly and provides a document confirming the country of origin of such goods (equipment) – a certificate of origin of the goods.
Question: Sample participant information form – What is EDRPOU Code?
Answer: EDRPOU Code (Unified State Register of Enterprises and Organizations of Ukraine) is a unique identification number of a legal entity in the Unified State Register of Enterprises and Organizations of Ukraine, assigned upon the registration of legal entities and individual entrepreneurs in Ukraine. For non-resident participants, this field shall be completed with the relevant data in accordance with the legislation of the non-resident’s country
